El litigio (expuesto a principios de diciembre de 2006 con la presentación de las conclusiones del Abogado General) versaba sobre las prácticas publicitarias utilizadas por la mercantil De Landtsheer en la comercialización de una cerveza muy especial, la Malheur Brut Réserve, en territorio belga. Al producto, una cerveza «achampañada» fabricada con un método inspirado en el de la elaboración del vino espumoso, se le intentó conferir el carácter de «excepcional», reservándole una imagen diferente de la que tiene la cerveza como bebida popular.
